Terms and Conditions
- Acceptance of Terms
By accepting a quote and/or making payment, the client agrees to all terms and conditions outlined herein. This acceptance also includes agreement to all designs, plans, and specifications provided by AllPro Solutions unless otherwise explicitly discussed and documented. The client also agrees to receive marketing material, ie. occasional emails from AllPro Solutions.
2. Cancellation Policy
Cancellations made after booking confirmation will incur a cancellation fee of 20% of the total quoted amount. Additionally, any costs already incurred for materials, labour, or work completed up to the point of cancellation will be charged. This is to cover any wasted costs and work already performed.
3. Cancellation Policy Exceptions
AllPro Solutions and the client may, at AllPro Solutions’ sole discretion, agree to alternative arrangements in place of the standard 20% cancellation fee. Such arrangements must be documented and mutually agreed upon in writing.
These alternative arrangements will become null and void under the following circumstances:
- The client fails to adhere to the agreed-upon terms of the alternative arrangement (e.g., failing to make payments or comply with deadlines).
- The client provides inaccurate or incomplete information that impacts the project scope or timeline.
- The client cancels the arrangement without prior written notice and approval from AllPro Solutions.
If the alternative arrangement is nullified under these conditions, the client will immediately be held liable for the standard 20% cancellation fee plus any costs incurred for materials, labour, or work completed up to the cancellation date.
4. Validity of Agreements and Dispute Resolution
- Written Agreement Requirement: Any verbal or negotiated arrangements between AllPro Solutions and the client are considered non-binding until a formal agreement is signed by both parties and returned to AllPro Solutions within three (3) calendar days from the date of issue. If the signed agreement is not returned within this timeframe, it will be considered void, and AllPro Solutions reserves the right to withdraw or amend the terms.
- Complaints and Dispute Handling: The client agrees to address any complaints or disputes directly with AllPro Solutions before contacting third parties, including external platforms or review sites. Failure to do so will result in the forfeiture of any alternative arrangements or goodwill measures offered by AllPro Solutions.
- Refunds in Absence of Agreement: If no signed agreement exists, AllPro Solutions reserves the right to refund the client in full and consider the matter closed. In such cases, the client acknowledges that AllPro Solutions holds no further liability or obligation to provide services.
5. Payment Terms
A 60% deposit is required upon acceptance of the quotation to secure the project booking. Final balances are due upon completion of contracted work and may not be withheld, reduced, or altered without prior written agreement. Non-payment of the balance within 7 days of completion will incur a late fee of minimum R500 per month until paid in full
6. Quote Validity
All quotes are valid for 30 days from the issuance date. After this period, prices and terms may be subject to change without notice.
7. Project Scope and Additional Costs
The project scope, as outlined in the initial quote, covers only the specified work and materials. Any client-requested changes, additions, or alterations outside the agreed-upon scope will be treated as additional work. This may result in extra charges and potential adjustments to the timeline. The client agrees that any design, material, or specification change will be quoted separately, with approval and payment required before work continues.
8. Design Fee Policy
- Design Fees: AllPro Solutions charges a design fee of R1500 (one thousand and five hundred rand) for every design or plan created for the client. This fee is non-refundable unless the client hires AllPro Solutions to complete the job for which the design was created. In this case, the design fee is waived.
- Waiver of Design Fee: AllPro Solutions reserves the right to waive the design fee at its sole discretion. Any such waiver must be documented in writing.
- Ownership of Designs: All designs remain the property of AllPro Solutions until the design fee is paid in full or the client proceeds with the designed job. The client is not permitted to use, share, or reproduce the designs without prior written consent from AllPro Solutions.
9. Approval of Designs and Specifications
The client is responsible for reviewing and approving all designs, plans, and specifications provided by AllPro Solutions. Once approved, any changes to these designs may incur additional charges and delays. AllPro Solutions is not liable for dissatisfaction arising from changes requested after initial design approval or for issues due to the client’s failure to review and approve designs thoroughly.
10. Workmanship Guarantee
All work completed by AllPro Solutions is guaranteed to meet industry standards. Any defects due to workmanship will be corrected at no additional cost within 2 years of project completion. This guarantee does not cover wear and tear,misuse, neglect, or damage caused by external factors outside of AllPro Solutions’ control.
11. Liability Limitations
AllPro Solutions cannot be held responsible for damage to underground services (water, fibre, electricity, sewage, etc.) unless such services have been clearly exposed, marked, or relocated prior to commencement of work. Responsibility for disclosure and marking rests with the property owner. AllPro Solutions is not responsible for delays, damages, or additional costs caused by circumstances beyond our control. This includes but is not limited to weather conditions, unforeseen site conditions, undisclosed site infrastructure, supply chain delays, or client-provided inaccuracies in information or instructions. Any resulting costs or timeline changes due to such circumstances will be communicated and addressed accordingly.
12. Site Access and Client Responsibilities
The client agrees to provide unrestricted access to the property and clear work areas as necessary to complete the project. Any delays or additional costs arising from restricted access, unsafe work conditions, or client-caused delays will be billed to the client accordingly. The client is also responsible for securing and clearing the work area before the project start date unless otherwise arranged with AllPro Solutions.
Abandonment of Work: If the client refuses to allow workers to complete a partially finished project, the Company may deem the project abandoned. In such cases, the Company retains the right to:
- Invoice the client for the completed portion of the work, including any additional costs incurred due to the client’s refusal to proceed.
- Withhold any refunds until the additional costs are settled.
13. Dispute or Cancellation Without Notice
No Prior Notice: In cases where the client refuses access to workers without providing notice or informs the Company after workers are already dispatched, the client will be held liable for all related costs and damages.
Chargeable Costs:
If the client’s actions result in wasted time, transportation, or labour costs, these will be billed at the following rates:
- Transportation: R10 per kilometre.
- Worker Wages: R400 per worker per day.
Payment Obligation: These costs will be added to the client’s invoice and must be paid in full within 7 days to avoid additional penalties.
14. Final Inspection and Acceptance
Upon project completion, the client is required to conduct a final inspection with AllPro Solutions. Any issues or corrections must be raised at this time, as acceptance of the completed work indicates satisfaction with the project. Any subsequent requests for changes or repairs may be subject to additional charges.
15. Warranties on Materials
AllPro Solutions sources materials from reputable suppliers; however, warranties on materials are subject to the terms and conditions of the respective manufacturers or suppliers. AllPro Solutions does not offer additional warranties on materials and is not liable for manufacturer defects, delays, or failures in supplied products.
16. Client-Supplied Materials
If the client provides any materials for the project, AllPro Solutions offers no warranties or guarantees on the performance, durability, or suitability of these materials. Any issues arising from client-supplied materials are the sole responsibility of the client, and any additional work required to address such issues will be billed separately.
17. Dispute Resolution
In the event of a dispute, AllPro Solutions and the client agree to make all reasonable efforts to resolve matters amicably. If a resolution cannot be reached, both parties agree to engage in mediation before pursuing further legalaction. Any legal disputes will be subject to the laws and jurisdiction of South Africa.
